You get early access by giving them your money today by staking and they promise they will deliver this new PoS chain and coin (eth2 eth) that will be available after launch. I don't think they should actually ban outright everything else (though I wouldn't complain if they did). I just think they should be considered securities, including ETH. Securities are traded everyday all over the world, they just have to trade under a certain set of disclosures about the entities behind the security itself. I don't think it should be limited to accredited investors or anything like that, just proper categorization for the assets in the space and following of those appropriate laws.

Bitcoin isn't the only coin to not pass the Howey test. Doge, Monero, Litecoin, BCH, clearly don't violate securities laws. There's even some weird gray areas it's hard to clearly categorize, for example Ethereum Classic as the base token ETH clearly was a security but does that still "infect" a community project that has no CEO or formal governance, I can see reasonable arguments both ways.
