I'm pretty sure securities represent ownership of a publicly traded company too, whereas crypto is more like crowdfunding or eBay or something where the ownership is of the items being being traded and not the underlying business

I doubt they can classify BNB as a security. It has some properties of a security, some people buy it expecting a return, but a lot of people buy small amounts specifically to pay trading fees on binance or to pay for gas on bsc. You also don't own part of binance by holding bnb. So it's kind if close to passing the howey test but it has multiple use cases some of which make it unlike a security. Even if they do regulate it who cares. Just about every exchange has it's own token too so if binance has to shut down then they all do
