Kek, they didn't charge because they KNOW they have no legal footing to stand on. This is nothing more then a glorified nanny state warning you not to invest in crypto. Remember they tried to say Bitcoin was a security too in their past press releases, their press releases mean jack shit!

you are right, insofar as it matters. The fed's don't prosecute, ever, unless its virutally certain they will win, thats why you only ever hear about people getting creamed by the gov in court, they don't pursue anything that isn't a slam dunk.
