I used to have a small little bit of btc change there and didn't think much about it because had two factor enabled and I was just going to hodl but checked it recently and not only was the btc gone but the history shows I never had any btc at all and there where never any transactions.

nope only a retard would get scammed. If anything the seller assumes most of the risk. once the transaction is sent its final. also you have to actually meet them in person and negotiate with a real human bean.

You can actually use the bitbay client to buy bitcoin with fiat, don't know specifics though.
I'm pretty sure you can ask in the bitbay slack, someone of the core team will usually sell you some
