someone LENDS you a stock and you sell it. Let's say 100 usd. You expect the stock to fall down. The stock price falls. You ARE OBLIGATED TO RETURN THE STOCK, NOT THE 100 USD. So you have 100 usd, the stock price is 20 usd and you buy a stock for 20 usd and give it back to the lender and keep 80 usd.
And here is where the risk goes apeshit.

How come? There's a record of every stock you've traded and what price it was when you traded it. Any gain you made on that stock from Jan 1 to Dec 31, you get taxed

Because part of capital gains tax is the capital loss tax credit? If you want to fuck the IRS infinitely you could just buy a stock on December 30, make sure it goes to shit on December 31, then back to the moon on January 1. Not to mention the people that write the tax code are the same ones that have most of their income taxed at 10% because of capital gains. An unrealized gains tax is a wealth tax but it would mostly fuck people about to retire. All around dumb, exploitable, and unenforceable.
