I think you could get them on misrepresentation or at a push, fraud, depending on what they told investors.
As far as I’m aware though, you’re right in that there’s no law that says they have to be backed.
It’s more a civil case of (i) what they led investors to believe (or that’s my understanding at least) (which is not a big deal even if they get got on it - they’ll pay compensation and move on), and (ii) Whether they were involved in artificially inflating asset prices through arrangements with other parties (printing and distributing unbacked tether with the aim of inflating assets and benefitting from the higher prices) (this would be the more serious charge)

I’m haven’t really looked into it that much, so this is just my high level understanding.

From what I can see, that has to do with reserved to be held with the Fed (presumably in order to access Fed liquidity). That’s separate from regulatory capital, which is what you hold against exposures (i.e. the fractional reserve banking).
