Also: from a liability perspective, that ruling was in 2015 (I think?). Ripple complied with the ruling from that date. A ruling from a regulatory body (in the absence of rulings from other regulatory bodies). I think they’ve got a solid Defense for all actions post 2015 based on that fact alone.

Also, yes, the SEC is the only one that can determine if It’s a security. But FINCEN and the DOJ are within their authority to determine it’s a currency. So it’s not as simple as SEC trumps all (as far as I’m aware).

The US regulators are notorious for competing for supremacy. This is more of that same bullshit.

I think you might be a little slow.
If you’ll forgive the appeal to authority, I am a derivatives lawyer. For a bank.
If a regulator says that’s a currency, then you treat it as a currency. You don’t have scope to say “no, we’ll treat it as a security” (even if you believe it is - you are, in the absence of a contrary ruling by a court or a superseding ruling by another regulator - bound by their determination.
Ripple has an almost complete Defense to anything that happened after the point at which they were told by multiple regulators to treat as a currency.
The SEC can argue that it was an incorrect call, but finding Ripple liable for complying with a regulatory order would be very difficult.
The SEC can get them on pre-2015 though.
(Even pre-2015 is assuming the SEC can successfully argue it’s a security, which is in itself questionable)
