it's not the financial punishment of the lawsuit it's the fact that if it loses the suit, it is a security and won't be able to be bought on any of the usual crypto exchanges. Since xrp relies so heavily on mouthbreathing retard normies that is more of a death sentence for xrp than probably any other coin that could be delisted.

there is nothing wrong with just waiting months for the lawsuit to clear. if they are then a non-security, fine buy into it for a cheap price, when you are early getting the message. i got out with little loss, suicide stack left because noone here can tell, what the lawsuits boils down to.

only argument against 'just wait out' is: 'hurrr youll be priced out the second the sec lawsuits clears them nonsecurity'. no there wont be the magical switch that puts it up to 1k. you might not get the bottom price because theres always other people early. but waiting for the lawsuit to clear and then maybe get in, seams the most reasonable low risk strategy.
