Clearly the incentive to 'make up a digital asset out of thin air' and then selling that asset to others for profit is definitely going to be claimed as a security.
If it's not FOR profit then it can be claimed that it's simply done to pay for operational costs. If at any point these operations were to promote and even market that they can be profitable, I believe then in that setting it can be situated as a security and those promoting it are held accountable; especially if they are part of the operation.
