While the value of XRP is affected by the actions of Ripple it is also affected by the actions of other independent organizations who also use the currency.

The fact that any organization could build with and use XRP completely independently and without even asking permission from Ripple makes it a token of value (read:currency) that is in all ways legally separated from Ripple as an organization.
