As written there's insufficient evidence. Whoever has a video of them sealing the box with the phone in or video of unboxing the magnets will win. Kleros might actually vote that there's no way to tell what happened and refuse to arbitrate.

I mean, what's your point? That in cases of hearsay court systems can't magically uncover the truth? No shit sherlock. An IRL court would just refuse to arbitrate and both parties would just report each other on a centralized site like ebay. Kleros isn't going to magically solve unsolvable problems.

Would be escalated and the courier would get involved. Once they confirm that the package was intact and it didn't have tampering. The customer would then upload this statement to the court case. The only logical explanation would be that the seller took the picture before packaging the 'phone' and replaced them with the magnets weighing the same.

The main issue with your proposed situation is that there is information missing. Cases don't get resolved in a matter of minutes on Kleros, they can take a little bit. The whole appeal of using Kleros however, is that it reduces the cost on the company managing the sale by lowering the cost of labor for customer support workers. The whole idea of this working synonymous with oracles however is that an oracle would give verifiable data proving it was untampered. Well at least once oracles are more integrated into things like our postal system.
