18198110 No.18198110 [Reply] [Original]

So Im fairly young. Weeks ago I worked as a tutor for kids.

I worked part time, 3 hours a day, 5 days a week. Minimum wage. I make roughly about $300- $400 biweekly.

After COVID hit, I was out of a job. Then my boss gave us remote work - same hours same pay.

Then I heard about unemployment and how unemployed get additional $600 PER WEEK.

Today my boss told us if we want to OPT OUT of the work he gave us, we can. But then it’ll be OUR CHOICE thus we aren’t UNEMPLOYED.

How can I get unemployed?

I dont care about this job, it’a very low entry level minimum wage job.

I would much rather get paid $600 per week working on my own things / or doing nothing vs doing work everyday and getting paid way less every two weeks.

I’m in NYC by the way.

Call the boss repeatedly and dont say anything. Leave a voice mail pretending to talk shot about him to someone. Tell him you wont work with chinks

You’ll make more in the long run keeping the job.

So what im understanding is that getting fired is the same thing as getting laid off?

If so thats easy, im just afraid that it’s NOT. Then I’d be out of a job AND cant collect any unemployment

No I wont. I tutor at a school so this job literally ends in June because school are done by then.

Like I said, this is a low entry minimum wage job.

My boss said my remote work should reflect the hours.

So if I start slacking seriously, and get less pay than before, is it enough?

Or do I have to slack hard enough to get FIRED?

Look up your state department for UI. It’ll tell you what you what quitting circumstances will still get you UI. Quit for the right reasons. Don’t fuck up. And if they deny you, appeal.

You may be eligible for benefits if:
You lost your job due to lack of work
The temporary or seasonal employment ended
Your job was eliminated
There was an involuntary reduction in force
The company downsized or shut down
The company restructured or reorganized
There was a lack of company operating funds/orders
You were out of work for any other business reason that you did not choose or control
Your employer discharged or fired you because you could not meet their performance or production standards, or their qualifications for the job
You may be denied benefits if you:
Were fired because you violated a company policy, rule or procedure, such as absenteeism or insubordination
Quit your job without good cause, such as a compelling personal reason
Are out of work because of a work stoppage (except for lockouts) in the last 14 days that violated an existing collective bargaining agreement where you worked (You need not actually take part in the strike, only be out of work because of it.)

What would be the “right reasons”

I want to make sure because i can be a retard sometimes.

$600 per week until July 31st is a lot of money for someone young like me living with my parents.

I dont want to fuck this up

Look around that website they’ll probably have more specific reasons outlined, I’m not doing research without a commission.
BUT your employer has a small financial incentive to dispute your claims, or your boss might be too lazy to.
If you get denied afterwards you could pay a 30% penalty. No reward without risk. But I recommend you appeal it if you do get denied. The administrative law judges usually rule in favor of the claimant.
Look up the specific rules not just the FAQ.

More importantly did you work long enough to qualify? The website should explain how eligibility works.

I think I should be, I started in September when the public school year started.

But ofc I will double check.

The issue Im facing is that boss refuses to lay us off and made it CLEAR putting emphasis on words like OPT OUT, CHOICE etc that if we quit we wont get unemployment.

>> No.18198338

He’s a dick but nonetheless I encourage you not to be an immoral cunt. If you do a shitty job in an effort to get fired you’re really just screwing over your students and their parents who have nothing to do with this particular issue. The website cited “compelling personal reasons” look up the definition of personal reasons (this is a bureaucracy it should be defined somewhere). Find an out for you to quit whether it’s enrolling in summer school or some bullshit about how the job isn’t the professional direction you want to go in.
Have a little integrity over quitting and getting UI rather than be a slacker who punishes your students.

>some bullshit about how the job isn’t the professional direction you want to go in.

Thats enough? Thats strange that personal reason like that is enough.

> Have a little integrity over quitting and getting UI rather than be a slacker who punishes your students.

I want to clarify this company is a non-profit and they been giving us online excel work for work on. We stopped tutoring students.

So Im not really screwing over the students

In California it is, but I dont know New York. That’s why you need to look up the rules.
Your boss sounds like a prick. It is possible he will dispute your claims by saying you were insubordinate rather than inadequate. You can try doing it your way and you might succeed, but if you find their list of valid reasons to quit (sometimes it’s by statute or regulatory code) he will have no counter argument, unlike your planned performance firing route. But you can go for it either way.

My boss is either a prick or his niceness screwed us.

My coworkers are younger in age like me. So when work stopped, I believe my boss just wanted us to work on something anything so we can continue to get paid during this troubling time.

Problem is that his niceness somehow screwed me.

Thats what I thought. Now Im not sure if he was being nice from the beginning at all, because he really did put emphasis on the OPT OUT and QUIT phrase.

I would like to clarify my boss doesnt pay me himself as this is a nonprofit

I thought about that.

The only thing stopping me is that I’m afraid that he’ll use that against me and deny my unemployment.

And hey dude, thanks for all the replies in this thread so far. You’ve been a great help
