I got (my mother accepted because she didn't know what was happening) served papers from a debt collector that bought my debt from my former credit union. It's around 4k, as much as I'd like to get into why the debt was accumulated I'm going to forgo that headache unless someone wants to know. I'm in the state of Utah and have just a few days to answer, but I'd like to fight it as I have no business with the collector, and I'm willing to lawyer up. I'd like to see if anyone has any general advise as far as this kind of thing goes. I'm in a shit situation financially and a former business owner, unemployed now, and with literally no assests. Is bankruptcy an option?

My strategy for the moment is to "answer" because I have to or else it will default and my future wages will be garnished, but I plan to respond "idk" in legalese. The one thing that concerns me is that they layed out in the service letter all the terms and whatnot from the credit union, literal screanshots. My one thing is that this collection agency has no in paper confirmation with me yet. One option is to explain without admitting any fault that I am unable finantially to put up with it as I've been helping my mother with her cancer treatment and I myself have not been able to work (I have written evidence here) due to medical shit (respiritory issue caused by my previous job that I didn't sue for, so now I'm boned with medical bills with now way to pay)

The reason you are in debt makes a huge difference as to whether you can tell them to fuck off or not. Also standard collection practice gives you thirty days to dispute your balance from the date you're served your letter. Who are you in debt to and what's the original date of the bill(not the date the agency received it, but the date you incurred original charges.)

Don't even worry about lawyering up. Just show up in court and contest the lawsuit. The company is expecting you not to show up, so they can get an easy default judgement against you and the thousands of other bad debts they bought for next to nothing.

Don't let them do this! They probably have very few records from the original creditor, most likely nothing that'll hold up in court. Say you don't know whose debt this is and tell them they've shown you nothing with your signature or the full history of the balance from the very beginning.

Their lawyer may "continue" the case and make you keep showing up in court, but if you keep showing up, eventually they'll give you a trial. Show up for trial and just say you don't know what the fuck this bill even is and point out that you've asked them for proof legal proof constantly but it was never provided.

I personally beat a $9k lawsuit over some bad debt from 6 years ago doing this. It was a hassle, but well worth it to see the judge just throw the case out and their lawyer tear up. Now it's wiped clean forever!

I also need to advise you to not cooperate with the bill collector at all. If they want your signature to request more documents, fuck 'em. The burden of proof is on them since they're suing you.

Most likely it's some huge firm that has contracted out a big batch of debt collection work to some local law firm, who has assigned one of their least essential employees to handle a few hundred of these cases at a time. They'll show up at court with "files" on like 200 of them to work through in a few hours, and if you demand they show you what they have it's likely very little. Usually just a bill of sale and maybe a couple of statements. That doesn't hold up in court so they count on you giving the case away. Fuck 'em!
