Here's why that doesn't work: In securities law, a sale and the instrument itself may or may not be securities. For instance, selling Beanie Babies as an investment contract doesn't make all Beanie Babies securities. Even if EF's sale of Ethereum resembled an investment contract, it's beyond the statute of limitations and doesn't affect ETH's security status. Proving ETH is a security would be tough, given existing caselaw and SEC's stance on Bitcoin. Any comparison to Ethereum would also apply to Bitcoin in terms of securities laws. The SEC's leniency on Bitcoin limits their maneuverability. PoS could be targeted, but decentralization isn't the issue; effort is, and PoS effort is comparable to PoW. EF received a voluntary information request, possibly part of an investigation they're involved in, rather than being directly investigated. The impact on the ETF is likely minimal. Seems like a fishing expedition by Gary, which could provide clarity on the situation.
