If there is a payout, everyone who was a holder will be paid. That defacto means the shorts are still open because the broker will be liable for the obligations pertaining to the shares he sold. And that defacto mean he can margin call anyone who is short in order to pay for that disbursement. This is only a problem if the company is naked short.
