If I understand the baggie thesis correctly, they're saying the company had enough assets to easily pay its debts, but short sales were crippling their ability to raise money. So they filed bankruptcy in an effort to shed or close short sales while still retaining the ability to raise money by reissuing stock. This would be illegal, and there is no legal mechanism to do it in the US. There's no way to bankrupt short sellers without also bankrupting regular shareholders, because they are the same people. The people that short stock own shares, and people that own shares usually also short stocks.
So if we get rid of that motivation right off the bat, the only reason to declare bankruptcy is because you legit don't have enough money to pay your debts. And this is also the only reason that will stand up in court. Usually it's not just a little low on cash, if you're a little low creditors will work with you. To find yourself in bankruptcy court you probably have enough money to pay less than a third of your debts. Because anything down to about a third, the creditor will probably accept the payment and you won't wind up in court.
