It's not illegal to daytrade with an account that doesn't have at least 25k in it, you just can't do it much on a non-options account without getting hit with a trading restriction for 90 days or permanently if you keep doing it. For options you have to have margin approval so it's basically etrade saying options and all positions are PCO if you don't have at least that much collateral and have margin enabled. People without margin are unaffected and still just beholden to the typical PDT rules for accounts without 25k balance, which is no selling unsettled shares and no more than one buy and sell of the same security or option in a given day. You can buy again or keep selling/buying as you did on your last move, but if you go buy-sell-buy on the same stock or option in a given day that's it and another trade is a PDT violation.

tl;dr if you don't have enough collateral you can basically only do one day-trade in a day. If you go past the three trade limit you get hit with a PDT which is typically a 90 day restriction but can become permanent if you keep doing it. It ain't illegal.
