Just following up on this post I made a few days ago: >>55578845

So, my gf's lawyers got paid $800k out of her $2.5 million settlement, so she only pockets $1.7million. Now her lawyers are asking for payment for a bunch of costs they accrued in covering her case, which amounts to an additional $40k. As such, I have a few questions:

1) Shouldn't these costs already be covered in the $800k payment to the lawyers?
2) If my gf never agreed to these costs ahead of time, she doesn't have to pay them, right?
3) If the lawyers didn't notify my gf that they were going to use these sources, she doesn't have to pay them, right?
4) If there is nothing in writing for points 2 & 3, she doesn't have to pay them, right?

Also, fuck lawyers. They are almost as bad as landlords.

My parents are lawyers and generally get at least 50% of the payout, more if the case went on for a very long time.

In fact they just had a case where a guy got a $1.8M payout and he owes $1M to the lawyers, and also owes $300k to his insurance who was paying him an income while out of work for a long time. So his 1.8M payout is leaving him with 500k lol.

Not sure about this, so I will ask the lawyer to produce the fee agreement. But couldn't they just fabricate it? As far as I know, the only agreement made was the payout to the lawyer, which amounted to about 33% of the settlement. That said, what if there is no fee agreement? The woman from the coffee case suffered absolutely horrific burns, and permanent disfigurement. Her legs and genitals were melted. I'm sure some of the incels here delight over that but the reasonable people sitting on the jury didn't. You know where the multimillion dollar sum came from? You are required to have a calculable basis for the amount you request. So, her lawyer came up with with the number based upon one day of McDonald's coffee sales. He argued that it would take at least that much for McDonald's to feel it enough to fix the problem. Because this McDonalds had been warned by health inspectors about the temperature of their coffee like 10 times. Then the big business lobby used this "absurd" judgment (that was reduced to way way less) as propaganda for tort reform. Cuz idiots hear coffee and millions and start parroting "we need tort reform!" When they don't even know what it means. So now you vote for tort reform, lose your leg in an accident because of some idiot, and oh sorry, your damages are capped at 150k. That will buy you a real fancy wheelchair though! No, legal fees are distinct from costs advanced. Fees are for the lawyer work (e.g., drafting the pleadings, taking depositions etc…). Costs are for expenses like process serving or hiring a stenographer to transcribe a deposition.

I guarantee you the retainer agreement she signed included a provision requiring her to pay for costs.
