If projects allude to their coin/token appreciating in monetary value, it is enough evidence to conclude that the coin/token is a security and the project can be sued for the illegal ICO/IPO what have you.

It's still an investment, whether or not it's a commodity or a security or what have you. It's just not a very good investment - though it did make people rich.
