I'm pleased to find out that I was wrong.
They still get to keep that in their back pocket, as a back up plan.
But we'll have to wait on that.

The fact that Ripple didn't even use the Fair Notice Defense is shocking.
But, as Jeremy explained, it makes sense.
They can still argue it later, once they get the Hinman emails.
Instead, Ripple is swiping their legal sword right as the SEC's stomach.

They found case law that an investment contract has to be a contract.
In other words, that the seller has to have a legal contract, obligating them to do some action, after the purchaser has bought.
No such contract exists anywhere in all of crypto.

The SEC is screwed if they lose this case.
They're going to lose a lot of their authority to go after other crypto companies.
I know they want to keep dragging it out.
But it's a dangerous game to play.
The longer they drag this out, the closer this case get's to finishing.
At a certain point, Ripple may not want to settle with them anymore.
Then the SEC will be stuck with the new case law that will be created from their loss.

The clock is ticking for the SEC.

My guess is 2025 we see the top of the bullrun, and no one will believe it - just like last time. If XRP gets something resembling clarity that will remove the fud, it will pump short-term to ATH and then pump again when relisted in the US. So by eoy 2023 - something like $4-5.
