Scams are scams, if he promised people something and stole their money instead, he can be prosecuted and under any legal system derived from roman law his punishment would be proportional to the value of the stolen assets. Regulatory frameworks exist to catch scams early (and to prevent goym from achieving financial independence).

It's an easy case to prove: he was promising a 20% return on Terra deposits and then using the money to pay back previous investors and to prop up the price of Luna. He had no legitimate way of generating the 20% return he promised besides enticing new investors, ergo it's a ponzi scheme.

Just look at the Bitconnect fiasco to get an idea of how the Luna situation will play out. The US Department of Justice was still filing new charges and making new arrests three years after Bitconnect collapsed. It's a slow process. But I guarantee that the process will end with Do Kwon in an American jail cell.
