That doesn’t make it a scam. They launched a public dag, corps said they wanted private, so they launched swirlds, and then corps said they wanted public, so they launched Hedera. Changing the consensus mechanism is irrelevant, especially if they believe they’ve solved the trilemma.

They invented a hashgraph which was a novel development in crypto and were subsequently awarded a patent. They were never closed source, they were open review. Forking is not a feature and is undesirable in any project. Why would you want to fork? To fix mistakes? Corps definitely don’t care if something is patented; that’s more a retail sentiment. Again crypto is bigger than retail, which is what I meant to say above. Obviously all crypto is defi.
