Depends on the company. When I was doing recruiting it was probably a 60/40 in favor of not doing reference checks. All of the positions I was doing executive recruiting for had reference checks. I totally believe you, I had an internship at a recruiters office once in the IT department. It's a total mess and really just a legal greyzone.

They spam call offices and pretend to be friends of people to get the secretaries to give them phone number of people there. Then they spam call them (usually fridays in the evening cause apparently people are in a better mood then) to try to get more info about them.

Their goal is to get them to quit the job and have a supposedly better position lined up. Usually pretty high paying jobs. But they charge a shitton like 20k or more for getting you the job (but considering you earn like 200k per year in those positions it's not much).
