Shkreli is said to have taken around 8 million in money that was not his to take so he could pay off a failed short position. That's a lot different than playing the hype with public information. Is it a crime when the hedge funds tell their friends what side of the bet they are on and suggest it would be wise for them to follow suit, if they do this in a public forum? Then why is it a problem when the little guy does it on a public forum?
