If the "double spend" is not registered on the same chain but merely in two different parallel blocks, then this is a complete nothing-burger.
Of course it's not ruled out at all that two blocks are created at the same time - but then the longest chain rule will still discard one. This is expected and it's why there's waiting times.

Just says that the 10min waiting time on Bitcoin is uncomfortably long, since 3 blocks of validation means 30mins to wait
