Because this has always been there, what happens is more confirmations need to happen. Once those confirmations are in, the double spend ends up not staying in the blockchain. That's why it takes multiple confirmations to be final.

1 pool accepted the fee bumped tx and made a block.
an other pool made a block with the original tx. and this latter won in the end and got included in the longest chain.

a miner will not start a new block and a new churn every time they see a fee bump. it's not economically worth to them to throw away their work.

If the "double spend" is not registered on the same chain but merely in two different parallel blocks, then this is a complete nothing-burger.
Of course it's not ruled out at all that two blocks are created at the same time - but then the longest chain rule will still discard one. This is expected and it's why there's waiting times.

Just says that the 10min waiting time on Bitcoin is uncomfortably long, since 3 blocks of validation means 30mins to wait
