25495617 No.25495617 [Reply] [Original]

I told my brother about BTC in early 2017 and he was interested and said we should both invest in it and split the cost. I spent $2000 of my own money to purchase BTC and told my brother he owed me $1000. He never paid me for the purchase. I asked him multiple times for the money over a period of about 3 months until I gave up. Over the weekend he texted me that he wants to cash out his half of our Bitcoin and that I should sell half of them keep $1000 as payment and then give the remainder to him. I texted back and said he never paid me for the BTC and so they are all mine and I'm not selling. He texted back saying if I don't sell he will go to the police. What do I do /biz? I don't want to sell and I feel like they are mine and not his.

Why the fuck do people tolerate toxic and narcissistic family members
A year ago I decided to stop speaking to my parents. They always contact me and ask what's wrong but I don't say anything. Enough is enough, if you don't like them you have no obligation to speak with them.

Surely you must understand this. At best you offered him some BTC as someone offered you at one point, but he just never bought any. It be like if I said “for awhile there I almost bought BTC when the smart people bought it, and because I almost made a shit load of money, I should get given a shit load now.” This is insane and I can’t believe you are asking about it.

Keep your circle tight, don't flex, say you received a heritage when you buy something. People will be envy and since you got buttcorns they think they can get some from you since you got "so much" and "remember everything they did for you".

This might sound skanky but it's the only way to avoid getting into even skankier shit by default: False friends, gold diggers, thieves, sharks waiting to benefit from you and straight up evil, envy bitches with a severe case of bucketcrab mentality await most rich people.

1. NEVER TALK TO THE POLICE. GET A LAWYER ANY TIME POLICE COME IN CONTACT WITH YOU. SERIOUSLY, NOT A WORD UNTIL YOU'VE WATCHED THIS VIDEO.
https://www.youtube.com/watch?v=d-7o9xYp7eE
2. If your brother is such a faggot he would call the police on family when he knows they occasionally kill people they interact with, you should get a restraining order against him. I'd do it immediately and bar contact and coming within a certain distance.
3. That's not how contracts work at all, he has literally no case since he never paid you the money. You could just ignore him, but since he threatened you with the force of the state I'd say getting a restraining order is a minimum and possibly you should talk to a lawyer just in case. He might lie and say you're money laundering or trafficking drugs to fuck with you and having a lawyer on retainer makes a huge difference.

It's an undeniable fact that every now and then the police use lethal force when called to situations that don't require it. Any time the force of the state is invoked it brings with it the risk of death for anyone involved. If there's not a significant risk to life or property, the police should never be called or even threatened to be called: it's no different than pointing a gun at someone's head even if you swear up and down it's unloaded. OP needs to get a restraining order for two reasons: one, it stops his brother from contacting him; two, when his brother calls the police and they pull your record and see you have a restraining order against him, they won't show up at your house. That's huge.

The words "friend" and "family" don't have power unto themselves, people pick and choose where they WANT to be in YOUR life by their own actions.

When it comes to court cases, the person with more cash usually wins and even then, in suing someone there is no winning, only degrees of losing. If one seeks revenge against another he should dig two graves.

If he does indeed sue you, he has made a choice about where he wants to be in your life.

This is a learning opportunity for you. Never hire friends or family, the same goes for business and investing opportunities.

some people are dangerous enough that they need to be on the system's radar, so to speak. And you don't want to be the person who did nothing if they go out and successfully hurt someone or do something dramatic. But apparently that recent bomber was on their radar and they dropped the ball so, fuck it.

The smartest thing to do here is to Tell him in a logical calm manner that you had all the risk by him never paying you therefore it’s yours.

Then when you cash out give him a good amount.

If all he sees are $$$ signs he’s not really someone that cares about you as a person.

Try to reason with him and say he Will get some cash when you cash out. But saying i owe you half is not right because You never payed and i had all the risk on me.

Then he’ll probably lie and say he forgot. At that point Tell him You know he’s lying and if he wants some cash when you cash out he better be honest and respectfull.

How much you give him is up to you. He never payed so the police can’t do anything.

Legally speaking, under the laws in pretty much all of the U.S., he never fulfilled his part of the contract, therefore he gets nothing.

Depending on your state, he might be able to go to Small Claims Court and present a case on his own. "Early 2017" suggests the amount is around 2BTC total, 1/2 of which he is pretending is his, which over the Small Claims limit in most states, but maybe not yours. You'd have to ask around or at least post the state and see if anyone knows.

Generally, from a life hassles standpoint, it comes down to whether he can afford an attorney, whether he wants to waste the money on an attorney, and how much trouble he can cause you over the situation, not just in court but also with the rest of your family, especially if your parents or other relatives are assholes who take his side.

I’m a lawyer and I can say with confidence that your brother has no case. If he bothers to sue you, get a lawyer. The lawyer will move to dismiss for failure to state a claim and any judge with a brain will dismiss. And then you can seek attorney fees from your brother, which the judge will also grant. For now, just tell your brother to fuck off.

Op if it’s a real story keep us posted if police get involved sounds lulzy

I was the idiot brother once too. I taught my brother how to invest, every stock to buy, when to buy, he double his money, made 40k, then I demanded half because I got him the money basically is what I thought. I got pretty bitchy and mad when he refused but got over it and asked forgiveness and then moved on.

Hopefully your brother will do the same thing.

The problem is you guys didn't agree on the time limit for the loan. Since a time limit wasn't concretely defined, we'll have to default to what most people would generally agree would be an acceptable time limit.

What most people would agree in this scenario, I'd say is on the order of a couple of months, and certainly not three years (2020). Now that we have a defined time limit, we can say that your brother failed to pay the loan on time, therefore the bank (you) gets to keep the collateral, therefore you get the BTC.

The key point is to define the time limit as something most people would generally agree upon. The lesson is you should concretely define time limits for stuff like this in the future.

>he reneged on a verbal agreement,
Verbal contracts can be just as binding as written ones. The issue here is that his brother never fulfilled his side of the contract.

>>25501492
>at most a loan or business venture.
DON'T put it that way. If you start making up possible ways for him to weasel around it, then a court is much more likely to find in his favor, all because you vacillated and made excuses for him.

You offered him a contract (give me $1000 to buy Bitcoin), he failed to fulfill his contractual obligations (paying you $1000), he is in breach (he never paid you the $1000), therefore he gets nothing.

no, it would not be small claims court. $1k of bitcoin in early 2017 is worth $35k now. That's way beyond small claims territory. STFU if you don't know what you're talking about.

This. People don't realize that the legal definition of a contract is extremely wide. It doesn't have to be drawn up by a notary. If you sign your name on a piece of cardboard that says "I will pay anon 1 btc in 2025 in exchange for blah blah blah," that can be enforced in a court of law.

If there's no physical contract or anything written, signed, executed, or endorsed, you have no legal duty to him and he would be hard pressed to find a lawyer willing to take his case.

And if there are text messages or something of those interactions, worst case scenario you would have to give him half of your btc at current market price.

Courts split assets by market value not by initial investment.

You have nothing to worry about. Contact a lawyer and don't speak or text your brother. Let your lawyer speak to him.
