yes I believe they can dig up bank statements or if they can't, they ask you to present your last two year's bank transactions, so unless OP paid for crypto at atms he may not be completely in the clear. however then they have to prove it was malicious intent rather than OP being a retard with his money. in a civil case I don't think they can do anything if OP wants to hold his crypto they can't do anything. They have to up the charges to fraud.
the law hasn't caught up to niche cases like this and won't until it becomes commonplace. it will probably be many many years and some sort of precedent first.

take note that if it were a civil case yes they can sure for assets but if you refuse to give up asssets then they take it to criminal court
in criminal court they would have to prove beyond a reasonable doubt that there was intent to commit fraud
