Can I realistically take business away from the client and start a competing firm when they decide to do layoffs? Anyone been in this position?

The law generally discourages no competition clauses. It is against the public interest to prevent individuals from working to their highest and best utility. That is not to say they won’t enforce it, but it would be very unlikely in the case where the company fires you. If you think you can actually make it, hire a lawyer.

Horseshit. Especially when he's talking about pulling their customer list. Every court in the US has upheld NDA's/NCC's even in marginal cases. You need two years to be reasonably clear of that shit, and many cases have upheld the boilerplate five years.

My contract has a 16 month NCC.

I have pretty decent savings and can focus on other ideas in the meantime. I can try to build the reputation of the business in another field before competing in the same field as my employer. This would involve waiting 16 months - 2 years for the Non-competition clause to wear off. Is this a reasonable strategy?

I understand I need to consult a good lawyer but there's no point in putting the cart in front of the horse here.
