The Howey Test is the SEC’s principal method of determining whether or not an investment is a securities offering.

People paid money to obtain XRP tokens. Obviously there was.

Yes. XRP holders all experience gains and losses when the value of the token fluctuates, influenced by if not based on the efforts of Ripple. I should also note that XRP is clearly centralized in the hands of Ripple.

Just look at any XRP thread on this board, you'll find the answer. Every retail investor is buying because they intend to profit.

I do not think anyone will disagree that the fate of XRP is tied to Ripple and the substantial effort Ripple puts into promoting XRP. I also don't think anyone would disagree that XRP's growth and corresponding profit for investors is driven by Ripple. Investors rely on Ripple to promote XRP, drive adoption, create new products and increase the value of the token.

In conclusion, cRipples are going to get BTFO tommorow.

The key word here is “solely.” When people buy xrp, they don’t expect profits based solely, or even mostly, on Ripple’s efforts. Rather, the expectation of profits comes from the retarded belief that the price will go up because more people will xrp it in the future. It’s basically a pyramid scheme, but that doesn’t mean it’s a security.
