The 50:1 leverage is only one problem. It's a pointless limitation in the US that was put in place to supposedly help traders, but it really only hinders them instead.
But, the real issue is the FIFO rules that makes you jump through hoops in order to hedge and scale in and out of your positions, and for someone like me who's trade plan revolves around scripts and lots of small tickets, it's almost impossible.

If by layers, you mean make each trade a separate position size, then yes, that is the way around it. But I use MT4 scripts to make my trades and I'm not writing a thousand different scripts with different pipette sizes that 'd have to constantly keep up with when I placed them so as not to overlap just so the nanny state will let me trade with them. No, a script is just a one-time executable. I still have to manually place them myself. For me, I use them to save time placing trades so I don't have to individually place every single order and type in the price levels of my stops and take profits and what not. Each script is tailored to a different situation. For example, one of my scripts is a double click that places a layer of 10 separate limit orders starting 3 pips above current price and spaced three pips apart all with a 20 pip take profit and stop loss.
