The gap only matters when the volume on the exchange, in this case CME, is large enough to actually create incentives for traders to go out and attempt to manipulate the spot price. It isn't guaranteed the gap will get filled, again, it all depends on how large the whales involved in the exchange are, and how much power they have to manipulate spot prices.
