price gouging is popping up because there's inefficiency in moving supplies. In a normal market the 'gougers' aren't gouging at all, they're just engaged in arbitrage. Business.

but in a market of necessity it becomes illegal.

and the main reason it doesn't happen is because price gougers are small time crooks, not businesspeople. Businesses are thinking of the long run and either not raising prices or even giving necessary goods away at a loss. Because they know you can't keep a business running if everyone hates you. Everyone hates gougers, so they're criminals, not businesspeople.
