17072021 No.17072021 [Reply] [Original]

Been married for 4.5 years. Now about to divorce (FREEDOM awaits!).

Have 220K in Crypto. We have no children and both my (soon to be ex) wife and me are working fulltime jobs. My biggest worry is that I have to split the crypto savings 50/50 with her. Does anyone know what the law says about that in Canada? I'll call a lawyer tomorrow but maybe someone here has an idea.

>> No.17072025

First question is; does she know about your crypto holdings because you constantly screamed in her ear whenever your stack of chainlink went up 5 cent?

Well if you ever breathed a word about it to her, or she had access to any device which you used to do your crypto business, or if you ever left any trace of it in any shared accounts, or if you ever did any customer-identity verification on any exchange, you're rolling some pretty big dice.

On the bright side, consider the possibility she has no idea what $110k in crypto is worth and idiotically sells it all in 2021-1.

>> No.17072036

Is it joint savings, as in invested money from both incomes? Does she have her own savings, her own investments? How were living expenditures split?
All these factor into whether you have to give anything or not. Ideally she is better off financially than you so dont gotta pay. Although idk how feminist canadian courts are.
Please say shes a doctor or something.

Yeah... this is what I also wonder about. No we never had a shared savings account or something like that. She makes half the money that I make in her job. There are so called spousal support calculators and none of them mention savings at all. Just says I have to support her for 2-4 years or something like that with max 340CAD. That wouldn't kill me.. but yeah I suppose I gotta talk to a familiy lawyer as a next step. I don't know what my wife is gonna do. At the moment she is not in a state to talk financials with her but its gonna happen soon.

I was thinking about this too but I've been reading some articles that warn about exactly this. I mean at the end of the day all that is somehow traceable and I don't know what would happen if there would be an official investigation going on about it. Might get me in some seriously hot waters and these articles warn explicitly to not do it.

Just talk to your lawyer and pay as they recommend, try to avoid court, family courts are fucked in Canada. Even if you put all of your own money in, and she invested nothing and just bought random shit, she will still get half.
You probably won't have to pay spousal support at least.
It's an expensive lesson but trying to hide things or doing anything to drag it out will just cost both of you and won't help your situation.

dont say anything that is false which will later be used as evidence against you, if you start down a path with a story that you havnet ironed out ever single minute detail then you risk losing the entire amount to her. If you say you 'lost it gambling' then you will need to provide evidence for that, that evidence gets examined by her lawyers and the judge so the amounts need to be well hidden from several different sets of prying eyes.

it is prob safer to just deny anything to do with crypto, never bring it up and since its not a tangable asset (like a car) it is very difficult to throw a rope around unless they have info like your pvt keys which you just deny you have any of
