If the whale has a large enough stake they might be picked for the majority of the appellate board too.
Kleros has not yet solved the Sybil attack problem. Maybe they will eventually decide to have KYC'd jurors to work around this problem?
A small whale with 20MM PNK could have 307 seats on the Blockchain Technical court (most expensive for staking), or 1000 seats on the Blockchain Non-Technical court.
Kleros has been running for almost a year, and in that time there have been a total of 79 jurors drawn. With those numbers, the system can easily be gamed by whales.
