It's hard to know what exactly this means. It looks like this post was actually ghost written by Openlaw, and Openlaw has been part of recent ISDA conference on smart derivatives contracts.

The thing is ISDA has not confirmed anything to do with chainlink and furthermore, Ciaran McGonnigle of ISDA gave a presentation recently that suggested that ISDA was still EXTREMELY early in adopting smart contracts. IOW they are working on using smart contracts to automate certain "back office" calculations and not planning any kind of full automation any time soon. OTOH I think oracles could be useful for these back office calculations, e.g. price of a commodity on a given date.

While it seems obvious to me that ISDA will at one point use chainlink, I can't tell if that is just hopium on my part and I can't tell what the timing of that will be.

Actually what is going to happen is that
1) certain LOW LEVEL agreements (think NDAs or basic leases or licensing agreements) may get automated to the point where not much legal input is required
2) in the short term, most agreements will be HYBRID agreements, e.g. partly automated smart contracts and partly traditional. ISDA has talked repeatedly about this -- that certain terms can be automated and certain ones cannot. Digital Asset folks have said something similar>
3. Most likely what we are going to see is VASTLY more complex contracts with lawyers playing a role in building them. This shit is NOT going to replace wall street lawyers who figure out 200 pages merger agreements or 100 page multinational licensing deals. Instead what it is going to do is turn those into 1000 page agreements. Think about what IDEs did for software developers. Did not ELIMINATE developers, quite the opposite. But made individual developers much more powerful to be able to, e.g. build website using Ruby on Rails.

Not saying that will play out same way here, but the point is that there are complicated factors that interact.

I can tell you that, for large enterprises, managing contracts is a shit show. Mostly handled by email and not very systematic at all. Also, they are negotiated "by hand" and so a typical company winds up with 2000 licensing agreements and 1000 leases and each are a little bit different and it's a big mess keeping track of it. Also, lots of folks spend their whole day in "contract management" doublechecking that the supplier had the amount of up time specified in the contract or delivered the xj249s on time. It's all very labor intensive and stupid and ripe for disruption.

the "making" the contracts part is a tiny part of the cost. It's the management and implementation of the contract, i.e. verifying delivery, fighting aobut discrepancies, that is the big cost and link + openlkaw vastly reduces those costs.

I have worked as a lawyer finalizing enterprise software sales agreements and I (mostly) agree with you. Lots of inefficiencies in the current system (as I mentioned). A few points though
1) the line between "legal points" and the deal points of a contract not always clear. May be in the future that MORE effort, not less will go into negotiating even more complicated contracts
2) not sure how easy it is going to be to replace current contracts with smart contracts. ISDA has done lots of interesting work thinking this through. Turns out to be very complicated to separate out the terms that are easily automated (e.g. database will have 99% uptime) vs not so easy to automate (provider will give reasonable notice in the event of a breach).
3) maybe this means that we see VASTLY more enterprise contracts getting negotiated, b/c won't take 4 months of back and forth to finalize them, so maybe each individual lawyer can handle 1000 contracts per year instead of 20 per year and employment stays the same.

Need to think about 2nd and 3rd order effects here and that is very hard to predict, especially wrt timing.

Agree but it is hard as hell to figure out what the TIMING of this will be.

In the mid 1990s smart folks were predicting rise of a combination phone, computer, web browser, navigation system, in your pocket but it took a LONG time, with lots of failed attempts, before smart phones became the multi billion dollar business they are today.

Lots of internal debate at apple about whether they should even pursue the iphone. In retrospect it all looks obvious but wasn't so obvious at the time (and see, e.g. Balmer's dismissal of the iphone).

One tough issue with smart contracts is that this is a PLATFORM play, i.e. you need BOTH sides to agree to use a smart contract. This creates a chicken and egg problem. I am SURE this will be solved,but I just don't know when.

It took a LONG time for Docusign to get to that point, and they had to face the same chicken and egg problem. Gonser discussed this in the fireside chat. In fact, IIRC that is part of why Gonser is excited to be advising chainlink: he's been through this before.

Not saying it won't happen, but they are going to have to address this issue and hard to predict how timing will play out.
