theres 2 issues here
1) ripple does not run all these validators they are chose strictly based on track record.... ripple doesnt talk to any of them in regards to what they vote on when updates comes up

2) you dont have to use this list :)
You are free to use any list of validators you want
Logically you want the ones acting in good faith and have a good track record
So pick those!
If you want to gamble on some new validators that come up that on you to!
You need over 80% to match what the majority says is "happening" on the network and you wont fork

You could use w.e list you want
Ripple doesnt run all the vailidators on the list
Updates to the chain are done via vote
