i assume the "improperly traded security" bit was in reference to Ripple's treatment of XRP in the past, i don't think anyone (even the SEC) is arguing that it's a security at this very moment- as evidenced by HM Treasury's very blatant statement that XRP is not a security but a 'digital exchange token' a few days ago- iirc this was literally the first thing the consultancy formed by the Brits did, which strikes me as a fairly straightforward method of providing clarity for XRP.
