RC owned 9.8% and sold to a third party, in a private transaction. No 16-B lawsuit. The third party, HBC was allowed to own 9.9% HBC probably friendly. RC probably re-bought shares at some point.

RC's Stand still agreement with BBBY allowed him to own up to 19.9% of share ownership.
