Business question

So there are two brothers that trust eachother 100%
one has $35+ in student loan debt which goes away after 10 years if unpaid
They both run a business which they plan to be in for life
The brother without any debt takes the business 100% ownership and all checks payable to him
The other brother is never paid, but the business owner brother pays for all his needs/wants and those of his family
in they have equal say in the business out of respect for eachother but in reality only one holds any assets
The brother with the debt is technically unemployed
they plan on living together in the same home with their families anyways
the business owner brother is basically just letting his bro stay with him and have whatever to help him out

is this illegal/fraud in the usa? couldn't you do this to get out of the debt?

What if we took it further
what if the brothers planned on living in a house with their mother who they also trust 100%
they put the business in the mothers name
all checks payable to her, they work for free (would they need a loophole? hurr internship? min wage?)
she pays for the house, cars, food, clothes, etc with every single title in her name

How does this sound to you? ever know anyone to do this?
