What are the ethics of holding someone captive against their will for not just a few years but the remainder of their life, for a nonviolent crime?

Sure, we can say we don't want this person in our society.
But what if another society in a different country is willing to accept this person?
Is it ethically justified to keep him trapped in a cell?

Our justice system is fucked up.
