1. He could "just do it", congress be damned, and what are they going to do when his new court rules his actions to be constitutional? A constitutional amendment? Like they have the numbers...
2. And speaking of the numbers, the only silver lining in this election for the Rs is that they gained seats in the congress. What nobody says is that it's still pretty damn close to a 50/50 split in both the house and the senate. It wouldn't take much at all for the Ds to take a majority, especially if the demographic shifts continue.

Now this is a battle I want to see. His new members will all say, yeah, the prez can do this, and some of the existing members will agree. But then can his packed appointees actually legally make a decision? It'll be one for the history books that's for sure.

OTOH, Biden will probably play it safe and not try any of these things.
