>solicitation subject to this regulation
this would be the solicitation of any security, which was previously actively done by recommending SLV in place of miner ETFs. >>21028740 which has been posted several times over and over. If you're going to argue over the term "soliciting", you then still would be violating Rule 10b-5: Employment of Manipulative and Deceptive Practices.
>It shall be unlawful for any person, directly or indirectly, by the use of any means or instrumentality of interstate commerce, or of the mails or of any facility of any national securities exchange,
>(a) To employ any device, scheme, or artifice to defraud,
>(b) To make any untrue statement of a material fact or to omit to state a material fact necessary in order to make the statements made, in the light of the circumstances under which they were made, not misleading, or
>(c) To engage in any act, practice, or course of business which operates or would operate as a fraud or deceit upon any person,
in connection with the purchase or sale of any security."
so you are still spreading information that would be damaging to the funds.
>GDXJ and SILJ are a paper shell companies...
They are not, they are the VanEck Vectors Junior Gold Miners ETF and ETFMG Prime Junior Silver Miners ETF. They are exchange traded funds, a type of security that involves a collection of securities.
>These take or pay contracts mean that the miners must deliver silver and gold at set prices far below the benchmark GLD and SLV standards
GLD and SLV are not standards, and the contents of these "take or pay" contracts between corps and buyers may not be info that is available to the public. This is then evidence of insider trading. It's doubtful you are tipping, but based on your ill intent, it can be assumed that you are spreading false information.
If anons went long on SLV or GLD and then there was force majeure, they can rip you a new one. Gookmoot and your VPNs will sell you out. You did it to yourself.
