That is true but states are not prohibited from issuing bank notes for gold and silver held in a state bank see pic related; see Biscoe v Kentucky where the Supreme Court ruled it constitutional.

It isn't a coincidence that states 23 states have recognized gold and silver as legal tender nor is it a coincidence that 5 states have permitted issue of the gold back voluntary currency.
