I know the SEC declares stocks under $5 to be penny stocks. But if a stock is hovering around $5 going over one minute and under the next, in what category is it considered? Is it constantly changing status? Will my broker likely charge me a fee if I order at $5 and the trade is executed at $4.99?

This will be the year to be in as many penny stocks as possible. The market will go into a frenzy with confidence once trump gets reelected knowing the results of his first term. By the end of 2021 we will be just under 40k points On the Dow. All of these companies like SCON or INPX that crashed down are going to rebound and create exploding pussies.
