If I bought "silver" from Alibaba for $2 an ounce and made no effort/attempt to test it, then sold it on Ebay, could I get in legal trouble?

I mean, maybe I just thought it was a really good deal for $2.oz then sold it for $12.

Also, if a manufacturer is selling their shit wholesale, but also at a massive mark-up that I can undercut by a lot and still make 300% percent profit, can I get in shit for doing it? Their product is surprisingly not shitty and highly-rated. The only problem is that they claim to have some sort of patent (which I can't find in the US database) but that doesn't matter if I buy it from them instead of getting a cheap fake, right?
