They are not the first either. Lichtenstein already declared it a currency last year.
UK declared it is NOT a security.
In the US, flare has to take the snapshot and it will become the excuse for further clarity. IE- flare will be the security offering on the ripple payment rails, thus, XRP cannot be a security.
Also, ripple cannot go public until the sec decides if their XRP is a commodity or a currency.

Key and scale may be OCC symbol. Brian brooks comptroller coming out repeating Ripple talking points on China tells me there could be something coming from them.
