Lol. Double deposit escrow makes it all possible, pic related. Both users put up a deposit, and if both users then do not adhere to the agreed upon terms of the contract, their deposits are blown up. Coupled with a reputation-based system through the client, this completely removes any economic incentive to violate the terms of a deal.

As for illicit activity on the marketplace, I have seen none.

Both parties lose the deposit. It would be an unfortunate situation but it's kind of like if someone buys something off you on eBay and the postman drops it into a vat of acid on the way, you're still fucked. This is a very basic explanation but that's how i understand it. here's that infographic

While I am knowledgable about BitBay, I am merely a marketing guy, not a 10-year Blockchain veteran. Short term:
1.) Website revamp
2.) Active social media management (that's me!)
3.) Bounty list to allow for outside actors to participate in the development/promotion of BAY and the decentralized marketplace
4.) List Youtube tutorial series on Bitbay.market for ease-of-access to interested Users

In the long term we will focus on things such as:
- large improvements in the UI (She works, but she ain't sexy or intuitive yet. Prioritizing functionality over form until we're ready for the next stage, and plus we can probably outsource development of "easy" stuff like making cooler looking buttons lol )
- Active marketplace with more consumer products
- Web wallet
