Ripple's work drives XRP's value in a way in which no entity does for BTC or ETH (where we have seen previous security rulings from the SEC).
Having looked at the Howey rule, this suggests to me that XRP is a security.
Are there non-Howey factors that the SEC is taking into consideration; e.g. nurturing the domestic cryptocurrency and blockchain industry?
