The problem is you guys didn't agree on the time limit for the loan. Since a time limit wasn't concretely defined, we'll have to default to what most people would generally agree would be an acceptable time limit.

What most people would agree in this scenario, I'd say is on the order of a couple of months, and certainly not three years (2020). Now that we have a defined time limit, we can say that your brother failed to pay the loan on time, therefore the bank (you) gets to keep the collateral, therefore you get the BTC.

The key point is to define the time limit as something most people would generally agree upon. The lesson is you should concretely define time limits for stuff like this in the future.
