It's called a False Negative

Most sellers will put "Neg" within their comment, but as you can see, these ones are pretty new to how it should be done.

Will pickup the false positives by checking for the "Neg" comment within the feedback.

To answer your question about what happens if he doesn't pay, nothing...
He won't be able to leave you a feedback and his account will be marked yet again with an unpaid item strike.

But seeing that he has all recent feedbacks as false negs, I wouldn't accept...
